Philadelphia VIOLATION OF RESTRAINING ORDER Lawyers
A restraining order is an order of the court providing legal protection to a party called the petitioner, from another party. A restraining order prevents the party restrained from such actions as contact with the petitioner and access to the petitioner’s residence.
Restraining Orders are used in domestic violence cases, child abuse cases and in other cases such as harassment. Each situation, in which a restraining order is sought, may require a different legal procedure and results in a different type of restraining order, such as:
- Protection from Abuse orders used in domestic violence or child abuse cases.
- Harassment Restraining order.
Violation of a Restraining Order is considered a criminal contempt or court, with fines ranging from $100 to $1000, and up to 6 months in jail.
A charge of Violation of a Restraining Order can be assessed for failure to abide by the requirements outlined in the Restraining Order and does not require that any other offenses be committed. If other offenses are committed during the Violation of the Restraining Order those additional offenses will be charged along with, and in addition to the charges assessed for Violation of the Restraining Order.
