Trespassing is a defined as a person entering a property inwhich they are not authorized, or remains in any place in which notice against trespass is given: Pennsylvania law has several categories of trespassing:
Criminal Trespass in when a person knowing they are not authorized to enter a property do so by subterfuge or by breaking into the property. If they enter by subterfuge it is a 3rd degree felony. If they break in it is a 2nd degree felony.
Defiant Trespass is when a person knowing that they are not licensed or privileged to do so enters or remains in any place in which notice against trespass is given by:
- Actual communication to the actor;
- Posting in a manner prescribed by law or reasonably likely to come to ones attention;
- Fencing or other enclosure manifestly designed to exclude intruders;
Defiant Trespass is a 3rd degree misdemeanor.
Simple Trespass is when a person, knowing that they are not licensed or privileged to do so, they enter or remain in any place for the purpose of:
- Threatening or terrorizing the owner or occupant of the premises;
- Starting or causing to be started any fire upon the premises; or
- Defacing or damaging the premises.
Simple Trespass is a Summary offense.
If an person is unaware that entry to an area is restricted then they might be exonerated of any charges of trespass.
