Robbery is defined as the taking of money or other property from the person or custody of another, with intent of permanently or temporarily depriving the person or the owner of the money or other property, and in the course of the taking of such, there is the use of force, violence, assault, or fear.
Robbery is a type of theft crime considered more serious than simple theft due to the potential violence involved. Robbery is the committing of theft which included the following aggravating factors:
- Bodily injury is inflicted upon another person
- Threats of injury or harm are made to another person
- A first or second degree felony is committed or threatened to be committed
- Force is used to physically take or remove property from another
These aggravating factors may take place during the act or offense or in the flight after the act or offense has been committed.
Robbery may be classified as a first, second or third degree felony depending on the specific offense.
- It is a 1st degree felony punishable by up to 20 years in prison if the robbery which caused or threatened serious bodily injury took place while a 1st or 2nddegree felony was being committed.
- It is a 2nd degree felony, punishable by up to 10 years in prison, to commit robbery which causes bodily injury or threatens bodily injury,.
- It is a 3rd degree felony, punishable by up to 7 years in prison, to commit robbery by force
Robbery in which the offender carried a firearm or other deadly weapon is a 1st degree felony.
