Under Pennsylvania Criminal Laws, crimes and penalties are categorized as Felonies, Misdemeanors or Summary Offenses. Felonies are the most serious crimes carrying the harshest penalties, with summary offenses being the least serious with penalties such as fines or jail time up to 90 days.

A misdemeanor is a less serious crime then a felony but more so then a summary offense. A misdemeanor can be punishable fines up to prison terms in a county or state facility. There are three categories of Misdemeanors, 1^st, 2^nd and 3^rd degree. Crimes considered Misdemeanors are broken up into degrees based upon the seriousness of the offense and the maximum prison term that may be penalized, along with the type of facility in which the sentence will be served, in convicted.

• Misdemeanor 2           Up to 2 Years in Prison
• Misdemeanor 3           Up to 1 Year in Prison
