MARIJUANA DUI STOPS

Recently a case (Commonwealth v. Jones) was decided concerning marijuana DUI stops, which the court ruled that odor of marijuana is enough to give the arresting officer probable cause to ask for a blood test under 75 Pa.C.S. §1547.

The Superior Court rejected defendant’s claim under Commonwealth v. Jones, that uncorroborated police testimony regarding the odor of marijuana was an insufficient basis to request blood testing under 75 Pa.C.S. §1547. Affirmed.
