EARLY TERMINATION OF PROBATION
When a person is convicted of a crime, the Judge may choose to grant Probation in lieu of a sentence. This Probation is a “conditional freedom” which is subject to specific regulation. Probation allows the defendant to remain free from prison under the conditions of good behavior and adherence to certain reporting requirements along with other case specific requirements such as participation in treatment programs and monetary restitution. Similar to a sentence of incarceration, a sentence of Probation comes with time limits specifying the duration of the Probation.
A person who is on Probation may petition the Judge for an Early Termination of Probation, if during the course of their Probation they have maintained good behavior, changed their lifestyle and feel that they can show the Judge that they are worthy of being released from supervision.
When considering a Petition for Early Termination of Probation, some of the factors the court considers are:
- Amount of time spent on Probation;
- Seriousness of the Original Offense;
- Age of the Defendant;
- Compliance with terms of the sentence;
- Payment of Fines, Costs and Restitution;
- Need for Relief;
The benefits to receiving an Early Termination to Probation are incalculable and immediately can make an impact on your life. Your employment opportunities increase and you become eligible for professional licenses and certificates, which may have been blocked by your probationary status. You become more eligible for student loans and for student loans in greater amounts. Social Services such as housing and assistance become available to you.
Legal Philly has Attorneys that will make sure your Petition is drafted correctly, so it is not rejected by the court, costing you months more of delay. We will tailor your Petition specificly to your circumstances, in order to create the most favorable impression possible when viewed by the Court. We will handle any objections from the District Attorney, including arguing the objections in court, if needed.
