Sometimes it’s essential to defer a sentence for mitigation purposes. Most judges allow for a deferral of sentence. Usually, Judges will provide lawyers with 30-60 days deferred sentencing date. In Pennsylvania it is important to get the assistant district attorney to agree on a deferral, otherwise, it may turn out to be a difficult task arguing your request in front of a judge.

There are several reasons to defer sentencing for mitigation. Here are some of those reasons:

1)      Providing ample time to address probation/parole violations;

2)      Cooperation;

3)      Immigration Issues; (Although, it’s important to avoid pleading to charges, until immigration issues have been resolved.)

4)      Obtaining Letters of Recommendation;

5)      Gathering family members for sentencing purposes;

6)      Gathering mitigating documentation;

7)      Restitution;

8)       Closing Open Other unrelated criminal matters;

9)      Developing Mitigating Factors (example: finding work for defendant…);

10)   Additional Prep Time with Clients;
