That second offense is a misdemeanor in the third degree, but if they violate a third time it will be in the first degree. The fine doubles to $5,000 and the time in jail quadruples to twenty-four months. A convicted person always has a chance of any of these penalties being reduced after driving while under a DUI suspension in Pennsylvania.
