EARLY TERMINATION OF PROBATION
When a person is convicted of a crime, the Judge may choose to grant Probation in lieu of a sentence. This Probation is a “conditional freedom” which is subject to specific regulation. Probation allows the defendant to remain free from prison under the conditions of good behavior and adherence to certain reporting requirements along with other case specific requirements such as participation in treatment programs and monetary restitution. Similar to a sentence of incarceration, a sentence of Probation comes with time limits specifying the duration of the Probation.
A person who is on Probation may petition the Judge for an Early Termination of Probation, if during the course of their Probation they have maintained good behavior, changed their lifestyle and feel that they can show the Judge that they are worthy of being released from supervision.
When considering a Petition for Early Termination of Probation, some of the factors the court considers are:
- Amount of time spent on Probation;
- Seriousness of the Original Offense;
- Age of the Defendant;
- Compliance with terms of the sentence;
- Payment of Fines, Costs and Restitution;
- Need for Relief;
